If you can no longer make your mortgage payments and your home is now worth less than you owe on it, FORECLOSURE may not be your only option. 

A SHORT SALE, in real-estate terms, is the sale of a house for less than what the owner still owes on the mortgage.  If the lender agrees to a short sale, the rest of the homeowner's debt typically is forgiven.  Lenders sometimes agree to the procedure in order to take a small loss and avoid the lengthy and costly foreclosure process.  While there are some significant negative consequences to a short sale, an ever increasing number of properties are being advertised with that label.

The beauty of short sales is that they can be a win-win-win situation for seller, buyer and lender.  Here's how:

  • The seller gets out of the mortgage liability without facing bankruptcy.
  • The buyer gets the home at a reduced price.
  • The lender agrees to loss it considers minimal without going through a foreclosure and being saddled with an unsalable property.

Through our experience in handling distressed properties at HomeSmart, we have found that homeowners today have more questions than answers about their circumstances.  We are offering to assist you with a consultation service that will provide you with insight into residential foreclosure process and the options available to homeowners like you.

Our THREE STEP process will get you on the road to selling your property in the shortest time possible.  You will be free to get on with your life without the burden of your loan payment.

STEP ONE

We will arrange for you to meet with our legal team that will analyze your circumstances as it relates to the potential foreclosure of your residential property and provide you with information as to available options.  To accomplish this goal, the following services are provided:

  • Analysis as to whether you should be afforded protection under the Arizona Anti-Deficiency Statutes.
  • A comprehensive overview and comparison of the foreclosure process and a typical short sale.
  • Information on the long-term financial and credit ramifications of a short sale and foreclosure.
  • Discussion of miscellaneous issues that will affect your rights and liabilities should you attempt to accomplish a short sale of your residential property.
  • The opportunity to seek in-depth advice on any other questions or concerns you may have regarding the disposition of your residential property.
  • Discussion of the additional services provided that may be of assistance to the homeowner.

STEP TWO

This step is initiated after you have made an informed decision to seek a short sale of your residential property.

Our legal team will utilize its best efforts to effectuate a negotiated settlement with your lender(s) that results in a written agreement providing a release of the liens(s) so the property can be sold to a third-party.  To accomplish this goal, the following services are provided by the legal team.

  • Negotiation with your lender(s) in an effort to have the lender(s) accept a discounted payoff in exchange for a release of its lien(s) and, potentially, in exchange for full satisfaction of the loan(s).
  • Analysis as to whether you should be afforded protection under the Arizona Anti-Deficiency Statutes.
  • In the event you are not protected under the Arizona Anti-Deficiency Statues, our legal team will negotiate with the seller's lender(s) prior to close of escrow in an attempt to mitigate and/or eliminate the seller's potential deficiency liability.
  • In the event your lender(s) asks you to execute a promissory note in exchange for a release of the liens, they will negotiate with the lender(s) in an effort to have the promissory note reduced or eliminated.
  • Assistance is provided to you in gathering all necessary documents required for the lender to process your short sale application.
  • Assistance is provided to you should the lender(s) have questions regarding the completion of the various forms and documents requested by your lender(s)
  • Management and protection of your sensitive personal and financial information and documents.
  • Periodic and timely update provided to you regarding the status of the short sale application.  Should you so desire, these updates will be shared by the legal team with the Christianson's, your real estate agents that have listed and are marketing your property.

STEP THREE

Bill and Frieda Christianson as your REALTORS® assist you in listing your property and see that it is actively marketed in a professional manner.  Any contracts that are received for your residence will be first seen by you and then integrated with the legal team to process and communicate with the lender on your behalf.  This process can be a Win-Win-Win for everyone.
